Un salario per vivere, come minimo, di Nicola Quondamatteo

Lunedì 3 luglio la questione salariale e del lavoro occupa le prime pagine dei principali quotidiani. Ne parla il Corriere della Sera, che ospita un’intervista a Francesca Re David, ex segretaria generale della Fiom e attualmente in segreteria nazionale della Cgil. Ne parla Repubblica, dando spazio ad alcune storie di vita del lavoro povero e gravemente sfruttato. Da nord a sud, in tutto il territorio nazionale. In particolare, prende parola un lavoratore cinquantaquattrenne, vigilante da 17 anni a Roma. Prende meno di 6 euro l’ora, ha aspettato per anni il rinnovo del contratto nazionale, che però ha distribuito solamente le briciole (nonostante diverse iniziative di sciopero, che hanno alleggerito le buste paga del personale che si è astenuto per protesta dal lavoro). Dice di non avere vita sociale e che a suo figlio ha consigliato una scuola professionale, non potendo garantirgli il proseguimento degli studi. Repubblica riporta poi la storia di Teresa, napoletana, cameriera ai piani.
Nonostante nell’albergo in cui lavora i costi delle camere siano lievitati da 100 a 300 euro (il settore turistico-ricettivo è uno di quelli in cui si sono verificati aumenti opportunistici dei prezzi con l’utilizzo della crisi inflazionistica come paravento), guadagnava e continua a guadagnare 8 euro l’ora. Si augura che la figlia, che ha frequentato l’alberghiero, si trasferisca all’estero piuttosto che andare a lavorare per 800 euro al mese. Infine parla Stefania, torinese, addetta alle pulizie, che con due lavori part-time arriva a 700 euro. Su La Stampa, invece, l’ex presidente dell’Inps Pasquale Tridico reitera il suo sostegno al salario minimo, mentre il segretario della Cisl Luigi Sbarra ribadisce la contrarietà della sua organizzazione. Su Domani si racconta invece la lotta che il Si Cobas sta portando avanti da oltre un mese a Campi Bisenzio contro il sistema di esternalizzazioni che fa capo a Mondo Convenienza. Lavoratori romeni, tunisini, pakistani, moldavi lottano da oltre un mese per i propri diritti e contro il dumping salariale. Gli viene applicato il contratto multiservizi anziché quello della logistica. Per un giorno, il lavoro in carne e ossa si prende il suo spazio anche nei principali quotidiani del paese – sullo sfondo dell’accordo raggiunto dalle opposizioni parlamentari (Partito democratico, Movimento 5 Stelle, Più Europa, Azione, Sinistra italiana ed Europa verde) per una proposta congiunta sul salario minimo.
Le diverse proposte di salario minimo
L’accordo tra i partiti di opposizione, con l’eccezione di Italia Viva, è stato raggiunto il 30 giugno. Prima dell’intesa, nel corso di questa legislatura erano state già presentate 6 proposte di legge sul salario minimo: una di Sinistra Italiana (prima firma Fratoianni), una del Movimento 5 Stelle (prima firma l’ex premier Giuseppe Conte), una del Terzo Polo (prima firma Richetti), tre riconducibili al Partito democratico (prima firma rispettivamente di Serracchiani, Laus e dell’ex Ministro del Lavoro Orlando). 
Nella proposta di Sinistra italiana il trattamento economico complessivo sarebbe stato stabilito dal Ccnl di categoria stipulato dalle organizzazioni sindacali comparativamente più rappresentative e il trattamento economico minimo non avrebbe potuto essere in ogni caso inferiore ai 10 euro lordi. Il salario minimo sarebbe stato rivalutato annualmente sulla base dell’aumento della variazione dei prezzi per le famiglie di operai e impiegati; l’indicizzazione avrebbe riguardato anche il trattamento economico complessivo del  contratto collettivo equiparabile, in caso esso non potesse essere applicato per scadenza o disdetta. Sarebbero state previste sanzioni da 1.000 a 10.000 euro per ciascun lavoratore al datore di lavoro o al committente inadempiente, cui si aggiungeva un ulteriore strumento sanzionatorio (da 500 a 1.000 euro) per ciascun lavoratore al datore di lavoro che affida consapevolmente l’esecuzione di opere o la prestazione di servizi a un soggetto esterno che non rispetta la normativa. Si predisponeva inoltre l’esclusione per due anni dalla partecipazione a gare pubbliche d’appalto e dalla concessione di qualsiasi agevolazione pubblica.
La proposta del Movimento 5 Stelle individuava un trattamento economico complessivo in linea con quello sancito dalla contrattazione collettiva, con un trattamento economico minimo comunque non inferiore ai 9 euro lordi l’ora. L’adeguamento all’inflazione era demandato a una Commissione Istituita ad hoc, che lo avrebbe rivalutato annualmente sulla base dell’Ipca (Indice dei prezzi al consumo armonizzato per i paesi dell’Unione europea). In caso di contratto collettivo di riferimento non applicabile perché scaduto o disdetto, ne veniva sancita l’ultrattività (e dal 2025 la rivalutazione annuale sulla base dell’Ipca). Per accompagnare la riforma, si disponeva in via sperimentale (dal 2023 al 2025) un’agevolazione fiscale – sia in termini di Irpef sia in termini di addizionali regionali – per gli incrementi previsti dai contratti collettivi nazionali di lavoro. Sull’aspetto sanzionatorio, la proposta faceva riferimento a decreti motivati e immediatamente esecutivi, da parte del giudice del lavoro, per imporre al datore di lavoro l’immediata corresponsione di quanto complessivamente evaso.
La proposta Orlando parlava di livelli retributivi stabiliti dai contratti nazionali più rappresentativi, fissando comunque per il trattamento una soglia inderogabile di 9,5 euro l’ora. L’aggiornamento automatico sarebbe avvenuto sulla base dell’Ipca solo per quanto riguarda i Ccnl scaduti e non rinnovati, fino al rinnovo del contratto e in ogni caso non oltre dodici mesi dalla scadenza prevista – con un apparato penalizzante per i Ccnl non rinnovati entro 12 mesi dalla scadenza. La proposta a prima firma Serracchiani, invece, parlava di salario minimo legale solo per gli ambiti non coperti da contratti collettivi nazionali e da determinare con apposito decreto ministeriale. L’aggiornamento dei livelli retributivi era demandato sempre a un decreto ministeriale da emanarsi annualmente.
L’apparato sanzionatorio previsto andava dai 1.000 ai 10.000 euro per ogni lavoratore, oltre al risarcimento del danno. Similmente, anche la proposta del parlamentare dem Laus non individuava una soglia e si sarebbe applicata solamente agli ambiti non coperti dalla contrattazione collettiva. Si sarebbe istituita una Commissione Paritetica per la rappresentanza e la contrattazione collettiva, a cui demandare sia l’individuazione del livello minimo sia la sua rivalutazione. L’apparato sanzionatorio era pressoché simile alla proposta di Serracchiani. 
La proposta del Terzo Polo individuava infine una soglia di 9 euro, comprensiva però delle somme corrisposte sotto forma di benefici accessori, dei contributi previdenziali e assistenziali integrativi. Si proponeva l’istituzione di una Commissione che avrebbe definito periodicità e modalità di aggiornamento. Per accompagnare la riforma, si faceva inoltre riferimento all’esclusione dei premi di risultato dal reddito imponibile e alla detassazione degli aumenti retributivi derivanti dalla contrattazione di secondo livello. Si predisponeva una disciplina transitoria, con 12 mesi di tempo per la contrattazione nazionale, territoriale e aziendale per adeguarsi alla soglia stabilita. Nessun riferimento, invece, all’apparato sanzionatorio. 
Come si può facilmente vedere, tre proposte (Fratoianni, Orlando, Conte) indicavano il riferimento alla contrattazione collettiva salvo indicare una soglia inderogabile per il trattamento economico minimo (rispettivamente 10, 9,5 e 9 euro); una proposta (Terzo Polo) individuava una soglia (onnicomprensiva di altre voci retributive) non collegata alla contrattazione collettiva; le ultime due proposte (Serracchiani e Laus) facevano riferimento soltanto a chi non è coperto da contrattazione collettiva, non individuando direttamente una soglia (demandata a decreto ministeriale o a un’apposita commissione).
I pro e i contro dell’accordo del 30 giugno
La proposta presentata dalle opposizioni merita un primo commento. Tra le note positive c’è sicuramente il collegamento istituito col trattamento economico complessivo sancito dalla contrattazione collettiva. Si individua inoltre una cifra di 9 euro, come trattamento economico minimo inderogabile. Positivo che questa cifra non comprenda altre voci, come aveva del resto garantito la parlamentare dem Maria Cecilia Guerra in un’intervista a Il Manifesto. Importante è anche il riconoscimento per legge dell’ultrattività dei contratti scaduti o disdetti.
Sul fronte delle note negative, invece, è da segnalare la mancanza di un meccanismo automatico di indicizzazione – tema rilevante nel pieno di una crisi inflazionistica che ha eroso fino al 15% del potere di acquisto di molte lavoratrici e lavoratori. Moltissimi, infatti, sono i contratti scaduti – specie nel terziario ma anche nel pubblico impiego (il governo non ha stanziato un euro per i comparti strategici della scuola e della sanità). Se alcuni rinnovi (ad es. legno e arredo) sono riusciti ad avere un effetto di recupero, quello della vigilanza privata, uno dei settori che sarebbero più positivamente interessati dall’introduzione di un salario minimo per legge, ha invece sancito uno status quo fatto di supersfruttamento, di cui in sede giudiziale è stata spesso accertata l’incostituzionalità ai sensi dell’Art. 36 della Carta del ‘48.
Nella proposta congiunta delle opposizioni si fa quindi riferimento, per la rivalutazione dell’importo minimo, all’istituzione di una commissione tripartita composta da rappresentanti delle parti sociali e istituzionali. Secondo il parere di Marco Barbieri, ordinario di Diritto del Lavoro presso l’Università di Bari audito sul tema del salario minimo presso la Commissione Lavoro della Camera dei Deputati il 27 giugno scorso, la costituzione di questa Commissione costituirebbe una sorta di autorità salariale terza, oltre alla contrattazione e alla legge. Il rischio è quello dell’introduzione di una sede di negoziazione parallela rispetto a quella contrattuale, che potrebbe indebolire proprio quest’ultima. Più semplice, nonché reattivo rispetto alla copertura immediata dell’inflazione quantomeno dei redditi più bassi, sarebbe un sistema complementare tra contrattazione collettiva e un salario minimo automaticamente rivalutato.   
Altra criticità è la previsione, pur transitoria, di un meccanismo compensativo per le imprese maggiormente interessate da un aumento del costo lavoro – scaricando in parte, pur temporaneamente, sulla fiscalità generale l’introduzione di una legge per rispondere ai bassi salari e alla povertà lavorativa. Si prevede poi un periodo transitorio di 12 mesi affinché la contrattazione collettiva possa arrivare di per sé alla soglia dei 9 euro. Difficile non considerare questo arco temporale piuttosto lungo, anche vista la non semplice approvazione a breve termine della proposta (per manifesta contrarietà governativa): la questione salariale, in tutta la sua drammaticità, morde ora e si sono già accumulati troppi ritardi. Non si fa infine riferimento a un apparato sanzionatorio per chi dovesse evadere la legge. 
Già qualche giorno prima dell’accordo tra le opposizioni, Tito Boeri – in audizione alla Camera dei Deputati – aveva segnalato una debolezza in questo senso delle 6 proposte precedenti. Va comunque sottolineato che, come accerta l’esperienza internazionale, la conformità delle aziende in materia di salario minimo è più semplice da controllare rispetto a quella agli standard della contrattazione collettiva. Inoltre, il salario minimo – nella sua semplicità – è un diritto individuale che con più probabilità un lavoratore conosce rispetto alle griglie stabilite dalla contrattazione. 
L’intesa ha dunque i suoi pro e i suoi contro. Per quanto riguarda le reazioni che ha suscitato, Cgil e Uil esprimono ormai un parere favorevole all’introduzione di un salario minimo capace di esercitare un ruolo complementare con la contrattazione collettiva. Rimane sullo sfondo la grande occasione persa, durante il secondo governo Conte, di legiferare in materia quando i rapporti di forza politici e parlamentari erano ben più favorevoli. Lo scetticismo del Partito democratico, la netta contrarietà della Cisl e una posizione ancora incerta di Cgil e Uil esercitarono, indubitabilmente, un ruolo di freno. L’esperienza europea ci dimostra infatti che i timori – non banali e da non sottovalutare – di un indebolimento della contrattazione collettiva possono essere superati disegnando uno strumento capace, come fa anche la proposta delle opposizioni, di tenere assieme entrambi gli elementi. Del resto, è quello che avviene in Belgio dove oltre al salario minimo c’è l’estensione erga omnes dei contratti collettivi, e addirittura la scala mobile (il grande sociologo Colin Crouch, in uno dei suoi ultimi contributi, lo cita non a caso come modello virtuoso). Anche in Germania il salario minimo non ha avuto un effetto negativo sulla contrattazione collettiva (che aveva subito una importante erosione in precedenza). L’IG Metall, importante sindacato dei metalmeccanici, era inizialmente su posizioni scettiche ma ha ora maturato un giudizio positivo sul ruolo di questa misura. In Spagna l’attuale governo ha agito in entrambe le direzioni, aumentando il salario minimo di oltre il 40% e riaffermando la prevalenza della contrattazione collettiva centralizzata.
Tra le reazioni negative all’accordo raggiunto dalle opposizioni si segnala innanzitutto quella del governo, sia con Giorgia Meloni sia con la ministra del Lavoro Calderone. Continua a essere contraria la Cisl. Contraria l’Ugl, che sostiene si debba dare priorità alla contrattazione e non all’intervento per legge. Naturalmente è la stessa Ugl spesso in prima linea nella stipula dei contratti pirata (dall’artigianato metalmeccanico ai riders del food delivery – compresi quelli di UberEats che rischiano di rimanere a casa senza ammortizzatori sociali dopo il 15 luglio), che rappresentano una quota non irrilevante della questione salariale italiana. Contraria anche Confesercenti (che ancora non ha rinnovato il contratto del terziario scaduto dal 2019), che sostiene tra l’altro di non avere lavoratori sotto la soglia. Un calcolo elementare dimostra, però, che – considerando il trattamento economico minimo – il 5° livello è di poco inferiore ai 9 euro, mentre il 6° e il 7° hanno retribuzioni ancora più basse. Il presidente di Confindustria Bonomi dice, invece, di non avere alcun problema e che non esiste alcun veto da parte della sua organizzazione. Auspichiamo sia consapevole che il salario minimo può aiutare, ad esempio, gli addetti alle pulizie industriali – che, nel comparto metalmeccanico, vengono affidate all’esterno anche a ditte che applicano il contratto dei servizi.
Per fare un esempio, lo abbiamo notato da vicino nell’ambito della nostra ricerca su Fincantieri dove, al di là dei problemi di diffusissima irregolarità retributiva negli appalti, le gare sottocosto hanno messo in difficoltà ditte storiche di pulizia che operavano all’interno del Ccnl metalmeccanico impossibilitate a sostenere i costi stracciati della concorrenza da parte di aziende che applicano accordi più competitivi. 
Italia Viva, che non ha firmato l’intesa con le altre opposizioni, ha sollevato critiche cui Calenda ha risposto dicendo di aver contribuito a una proposta equilibrata che ha evitato l’indicizzazione automatica e un’ipotetica spirale salari-prezzi. Ipotetica, perché dovremmo sapere – al contrario – che stiamo affrontando un’inflazione trainata principalmente dai profitti come hanno certificato anche il Fondo monetario internazionale e la Banca centrale europea. Pietro Ichino – da sempre sostenitore delle «gabbie salariali» – ha invece espresso la necessità di un salario minimo differenziato su base regionale. Al contrario sarebbe importante sottolineare il ruolo che il salario minimo – naturalmente omogeneo su tutto il territorio nazionale – potrebbe avere nell’affrontare le disparità intra-nazionali. In Germania, del resto, di questa misura hanno beneficiato maggiormente i lavoratori della parte orientale del paese, a riprova del fatto che questo strumento va pensato anche in ottica di riduzione delle disuguaglianze territoriali (nonché di genere). 
Scenari futuri
Il dibattito sul salario minimo ha avuto il merito di riaprire la possibilità di una discussione sulla questione degli stipendi. La necessità dell’introduzione di una soglia minima, a nostro avviso, è fuori discussione. L’esito amaro del rinnovo del Ccnl della vigilanza privata lo testimonia. Può essere importante ricordare che poco prima del rinnovo le categorie interessate di Cgil e Cisl avevano messo in campo una class action contro il contratto (da loro stesse sottoscritto), a riprova dell’erosione della contrattazione nel contesto della terziarizzazione. 
Lo stato dell’arte più generale rimane segnato da difficoltà e arretratezze. Le organizzazioni confederali continuano a confidare troppo nella riduzione del cuneo fiscale, visto come strumento rilevante di sostegno alle buste paga. Nel giudizio di chi scrive, resta una posizione sbagliata trattandosi di un incentivo per le imprese e non di un aumento a carico dei profitti nel conflitto distributivo. Il cuneo fiscale italiano è inoltre inferiore a quello belga, a quello tedesco, a quello austriaco e a quello francese ed è solo di poco superiore alla media dell’Europa occidentale. Ridurlo strutturalmente è inoltre una manovra costosa, che priverebbe il bilancio dello Stato – specie mentre si riaffacciano gli spettri dell’austerity europea – di risorse che potrebbero utilmente essere destinate a sostenere il salario indiretto dei lavoratori tramite investimenti strutturali nell’educazione, nella sanità, negli asili nido, nella mobilità collettiva ed ecologicamente sostenibile.
Caricare la questione salariale sulle spalle del fisco è un limite, specie se si vuole difendere e rilanciare il carattere universalistico delle prestazioni offerte in natura dallo Stato. Ancora più problematica è la proposta della Cisl (nonché del Terzo Polo) di detassare massivamente la contrattazione di secondo livello, il che aumenterebbe le disuguaglianze interne alla forza lavoro.
Il Decreto Lavoro, approvato definitivamente, liberalizza inoltre il ricorso ai contratti a termine (oltre che i voucher). Come ricorda giustamente l’ex presidente dell’Inps Tridico nel suo recente libro, la precarietà è un altro importante vettore di moderazione salariale. Meno scatti di anzianità, meno possibilità di ricevere un premio di produzione, meno capacità contrattuale sul posto di lavoro.
Il fatto che la proposta di salario minimo in esame difficilmente possa essere a breve approvata offre una finestra temporale di opportunità per sindacati, forze politiche, movimenti sociali, associazioni per una discussione generale sulle condizioni di lavoro e di vita nel nostro paese. Anche ricordando le altre iniziative nate fuori dal circuito istituzionale: dalla legge di iniziativa popolare lanciata da Unione popolare (meritoriamente attenta alla questione sanzionatoria) alla campagna di attivazione di Up! Su la testa!, che individuano entrambe in 10 euro la retribuzione minima.
La discussione più generale necessita di una mobilitazione complessiva che tenga assieme il salario minimo, la critica allo smantellamento del Reddito di cittadinanza, l’opposizione all’estensione del precariato voluta dal governo, i contratti fermi (compresi quelli pubblici sui quali, in qualità di datore di lavoro, lo Stato non sta dando il buon esempio al settore privato), un intervento su altre questioni che incidono drammaticamente sulla qualità e la giusta retribuzione del lavoro (part-time, appalti e subappalti, tirocini, falso lavoro autonomo, gig economy – su cui continua l’iter legislativo europeo). Anche recentemente il conflitto ha dimostrato di pagare – si veda il rinnovo contrattuale del legno e arredo (ottenuto con scioperi e mobilitazioni) o la positiva vertenza dei lavoratori esternalizzati dei musei civici di Trieste. Sarebbe bene che l’Italia non rimanga fanalino di coda in Europa quanto a livello di mobilitazione sociale.
